On 14.05.2025, a round table organized by the Initiative for the Development of Enforcement (IDDE) and the Sofia Bar Council (SBC) was held at the Center for Lawyers’ Training “Krustyu Tsonchev”. Discussions touched on the cooperation between professionals in the different legal professions, the ethical issues in their practice, the challenges faced in the course of the evolving market opportunities, and the legal services that can be provided to citizens and businesses in the course of this development.

The event was attended by Atty. Emilian Arnaudov, Managing Partner at Popov, Arnaudov & Partners and an expert with many years of experience in copyright, related rights and e-governance. He spoke about the problems faced by persons whose rights are infringed in certain incidents and non-permanent conditions – a topic of particular importance as it covers a wide range of possible damages – pecuniary or non-pecuniary. These may be damages due to the wrongful use of an intellectual property right or those caused by the improper exploitation of construction sites. It could also be damage from the dissemination of defamatory information on the internet or even physical damage due to the failure to maintain road infrastructure.

Attorney Arnaudov emphasized the difficulty in proving the incident or condition that caused the injuries. He pointed out that often in such situations, by the time it comes to filing a lawsuit, the violation is already over, and even covered up.  The possibility of a bailiff taking a report, with the involvement of a lawyer and the use of the necessary technical means, was presented as one of the possible options.

In the course of the discussion, it was pointed out that the existence of a statement of the facts would in many cases also push the parties towards an out-of-court settlement.
